These Terms of Service (“Terms”) govern your access to and use of the Carepoint website, Carepoint Connect platform, and any related tools, services, communications, or content (collectively, the “Services”) operated by Carepoint (“Carepoint,” “we,” “our,” or “us”). The Services are provided for informational and business purposes within the U.S. healthcare insurance distribution ecosystem. Certain features of the Services may be subject to additional guidelines, policies, or terms, which are incorporated into these Terms by reference. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
The Services are intended for individuals and entities operating within the United States, including licensed insurance agents, agencies, carrier partners, and prospective participants. By using the Services, you represent that you are at least 18 years of age, legally capable of entering into a binding agreement, and compliant with all applicable laws and regulatory requirements. If you do not meet these conditions, you are not authorized to use the Services.
Carepoint may update or revise these Terms at any time in its sole discretion. Changes will take effect immediately upon posting. Your continued use of the Services following any updates constitutes your acceptance of those changes. You are responsible for reviewing these Terms periodically.
Carepoint operates as a Field Marketing Organization (FMO), providing infrastructure, technology, and support to facilitate insurance distribution. Carepoint does not act as an insurer, does not issue insurance policies, and does not control underwriting decisions, product availability, or carrier actions. All insurance products referenced or accessed through the Services are offered by licensed insurance carriers and are subject to their own terms and regulatory oversight. Any information provided through the Services is for general informational purposes only and should not be relied upon as financial, legal, or insurance advice.
To access certain features, you may be required to provide personal or business information. You agree that all information you provide is accurate, current, and complete. All data collected through the Services is governed by our Privacy Policy, and by using the Services, you consent to the collection, use, and handling of your information in accordance with that policy.
Access to Carepoint Connect and related systems is provided for authorized business use only. You agree not to misuse the platform, attempt unauthorized access, copy or replicate functionality, reverse engineer any portion of the system, or use the Services to develop competing solutions. You may not use the Services in violation of any applicable law or regulation. Any unauthorized use may result in immediate suspension or termination of access.
All content, design, software, text, graphics, and materials available through the Services are owned by Carepoint or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to access and use the Services for permitted purposes only. No ownership rights are transferred to you. Any unauthorized use may violate applicable laws.
You agree not to: reproduce, distribute, modify, or publicly display any part of the Services; use the Services for commercial exploitation outside their intended purpose; attempt to gain unauthorized access to systems; or use the Services in any manner that could damage, disable, or impair functionality. You may not use the Services to create competing products or services.
If you provide suggestions, ideas, or feedback regarding the Services, you grant Carepoint the unrestricted right to use, modify, and implement such feedback without compensation or obligation. Any feedback submitted will be treated as non-confidential.
The Carepoint name, logo, and related branding are proprietary trademarks. You may not use them without prior written consent. All other trademarks appearing within the Services belong to their respective owners.
Information presented through the Services is provided for general informational purposes only. Carepoint does not guarantee accuracy, completeness, or usefulness. Any reliance on such information is at your own risk. The Services may include content provided by third parties, and Carepoint is not responsible for the accuracy or reliability of such content.
The Services may contain links or integrations with third-party websites, applications, or services. Carepoint does not control or endorse these third parties and is not responsible for their content, practices, or policies. Your use of third-party services is at your own risk and subject to their respective terms.
Users are solely responsible for complying with all applicable laws, including licensing, certification, and regulatory requirements such as CMS guidelines. While Carepoint provides tools to support compliance, it does not assume responsibility for user compliance or regulatory outcomes.
By submitting your information through the Services, you consent to receive communications from Carepoint, including emails, phone calls, and text messages where permitted by law. These communications may include marketing, promotional content, training opportunities, product updates, and business-related outreach. You may opt out of marketing communications at any time.
The Services are provided on an “as is” and “as available” basis without warranties of any kind. Carepoint does not guarantee that the Services will be uninterrupted, error-free, secure, or meet your expectations. All implied warranties, including merchantability and fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.
To the fullest extent permitted by law, Carepoint shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data. Total liability for any claim shall not exceed $100 USD. Some jurisdictions may not allow certain limitations, so portions of this section may not apply.
You agree to defend and indemnify Carepoint and its affiliates from any claims, damages, liabilities, or expenses arising from your use of the Services, violation of these Terms, or failure to comply with applicable laws.
Carepoint may suspend or terminate your access to the Services at any time for any reason, including violations of these Terms. Upon termination, your right to use the Services ceases immediately. Certain provisions of these Terms will survive termination.
These Terms constitute the entire agreement between you and Carepoint regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms do not create any partnership, employment, or agency relationship. Carepoint may comply with legal requests and regulatory requirements related to your use of the Services.
These Terms are governed by the laws of the State of Florida, United States.
